Master Post

Hi folks.  Thanks for the info and the kind messages.  I've been out of pocket recently.  So far so good.

First up -- here is the link for a copy the message I found on my answering machine Saturday night:

And a big THANK YOU to the cybergeeks who did that for me.  If you want to help and have the ability, please mirror that for me.  I'll add your links in later.

If you would,  please someone make a slideshow using the audio and the transcript I posted earlier and post it to youtube.  Please mirror that as well, and forward to anyone who might be interested in civil rights.  Thank you.

Second -- DHS

According to the lawyer we hired to handle the DHS end, he spent three hours badgering them before they would even admit  to having my name in their files.  Then they wanted a release form.  Then they spent even more hours giving him the runaround -- wrong person, wrong office, wrong directions et al.  Then when he asked them to write down the complaint, they said a bunch of hooey but have so far refused to put anything in writing.  ('m not surprised, because they never gave us anythign in writing either.)   Some of the hooey isn't even legal in Mississippi.

They complained --

the house isn't clean enough, even though we cleaned it to their earlier (verbal) specs and got their (verbal) approval;

the floor isn't fixed,  even though we repaired it to their earlier (verbal) specs and got their (verbal) approval;

(There was a background sense that we weren't acting "White enough", that we weren't living the way people of our socio-economic standing should live.  That instead of buying a trailer and some land in the country, and building extensions as we went along, we should have "properly" bought a pre-made house in the suburbs and tied ourselves down with a huge mortgage.   That we should buy all-new furniture instead of taking care of the old stuff we have.  Apparently one can't be frugal and be a "good" person.

Some of the property is old, but it's all in good shape.  The additions were built at above US Navy standards.);

that our homeschooled children needed to be tested to see if they were learning enough.  THIS IS ILLEGAL IN MISSISSIPPI.  Homeschooled children in Mississippi have to meet no testing requirements whatsoever:  http://www.hslda.org/laws/analysis/Mississippi.pdf  In fact:

"It is not the intention of this section to impair the primary right and the obligation of the parent ... to choose the proper education and training" for their children, and nothing in this section shall be construed to grant the State of Mississippi "authority to control, manage or supervise" the private education of children. "And this section shall never be construed so as to grant, by implication or otherwise, any right or authority to any state agency or other entity to control, manage, supervise, provide for or affect the operation, management, program, curriculum, admissions policy or discipline of any such school or home instruction program." Miss. Code Ann. § 37-13-91(9).

(The funny part of this is that  when they asked to see the girls' schoolwork and I showed them their Singapore Math notebooks, Patti Young, aka DHS-1, couldn't even read the problems correctly out of my 9yo's workbook, and declared the 11yo's workbook was above her head.);

that our children need to be given a medical exam and vaccinated.  Okay, we were holding off to see how the mercury content in modern vaccines was being handled, but the kids are old enough they may be safe.  (I had an extremely bad reaction to an MMR shot once, and I was 21 at the time.)   Still THIS IS ILLEGAL IN MISSISSIPPI.  Only children entering the school system have to be vaccinated.  http://www.msdh.state.ms.us/msdhsite/_static/14,0,71.html

(Also there was an issue with the age of the vaccines.  I was at the County Health Clinic one day when a batch of "fresh" vaccines arrived and was left sitting on the reception counter.  They were already out of date and had been culled from another medical center, with all the proper markers for rejects.  This sort of thing does not inspire confidence.);

that I am "too depressed" to "properly watch my children" or to "properly homeschool".  THIS IS ILLEGAL IN MISSISSIPPI.    There's no requirements for homeschool teachers in our state;

that I should send them a copy of any lease I sign anywhere else so they can check out my new home and so they can transfer my case instead of closing it.

They said (but didn't put in writing) that if I moved they would drop the case.  That doesn't jive with the above statement.

The lawyer wants to comply with all this.  I suspect much of it will actually evaporate when they have to put it in writing.

Third -- the matter of the break-ins and the Sherrif's Department's actions.  We're still working on this end.  Everyone who hears about it is horrified, but most don't want to get involved.

Gotta go.  Please pass this story along to any homeschool advocates, including Mississippi homeschool advocates, the Mississippi state senator who chairs the education committee, and anyone else who may be interested.  Thanks.

what a load of crap, DHS. A big, fat load of crap, every last bit of it. Apparently they don't their own laws. Apparently they also need to be SLAPPED IN THE FACE with their own laws. For the love of.... yeesh.

Keep going, keep demanding proof of *their* demands, and keep strong. We're all pulling for you.

Here by a friend of a friend.
If you weren't depressed before, you should be by now. Holy cats. I keep hoping this is some strange "creative writing" meme.

Thank G-d you finally have a lawyer! Not only do I hope you get everyone to back off, I hope you can sue and get a nice fat settlement for harassment.

Put your house on the market for 3 times it's actual worth, and see what happens. All kinds of things might come to the surface.

This becomes more and more un-freaking-believable by the moment, and smells more and more and more like harassment. Have you thought about talking to the ACLU about the infringement of your rights to homeschool? That would be some nasty publicity and might get the ball rolling in other areas too.

I'm really glad you're ok...when you didn't post right away my imagination was taking the better of me and I was really worried that your neighbors had done something (even more!) horrible to you.

Hopefully you will get the DHS fiasco straightened out...a lot of what they're spouting seems made up (obviously!) to me and as a way to force you off the property they so obviously want you out of for whatever reason. But I hope you still involve the ACLU or FBI or whoever else you can get to listen to you to keep you and your family safe and those arseholes in jail where they obviously belong!

Good news so far. Please keep us posted, you have a lot of people rooting for you and hoping you are staying safe and ahead and away from these assholes!

I've been watching this for a couple days now wishing I knew what to do so I could help. But I don't. So I just keep thinking/praying that everything will start working out for you.

I too started to wonder when I hadn't seen a post yet today.

Civil rights lawyer
From the dh:
Okolona police have identified (at least off the record) one of the voices on the tape as a deputy sheriff and recommended we get a civil rights lawyer.
But none in the immediate area will touch it, most having done work for the sheriff's department, or the sheriff, in the past.
If anyone truly wants to help, please put this story in front of every civil rights lawyer you can think of, every reporter, every homeschooler, everyone who might have any interest in this.
I am not so certain the current lawyer is fully on our side. He set up the appointment Sunday night and was texting just after I told him about the taped message; and our house was entered again and original erased when we returned.
However, it is finally forcing this to be put into writing.
We will post everything when we get it. We have nothing to hide. Someone else does.
Due to the current set of situations, our abilities to make contacts are severely limited. We need someone to start making calls for uis, or forwarding these links to somebody who might do something: ACLU, FBI, NPR, etc., and everybody you know.

Male 1-Let me know cause I'm saying all you can commit
(and then 'no'. they have always threw a fit

-- if you bring a petula(?) it's going to be, "Hey you."
these crazy (something..coutores? sp? like high fashion...kinda sounds like they're pretty much calling you snobs:S) going "hey you", because she gotta go out and visit people

but she can write them up. And you know, everybody should be told to bring somebody. So you know, you're paying for it.

^--that part..it sounds kinda like he's saying you did something "wrong", and now you're gonna be paying for it:S

sorry I'm not much help, but I have friends who are good at making out things like this, so I'll ask some of them to check it out~

Wow. I'd be freaked out just by this voice mail- nevermind all the other shit! I've downloaded it to my computer as a backup for you.

REALLY glad to see your update today- was worried about you & your family! BTW, I meant what I said in my PM to you. If you think that would help, or if you need my help for anything else (storage & whatnot) just let me know.

Oct. 14th, 2010 12:24 pm (UTC)
I'm downloading the files and I'll mirror them as soon as I get home from work. the backup is also on my hard drive and terabyte, just to be sure.

Hi, I heard about your story and wanted to tell you how sorry I am to hear this is happening to your family.

I did have a suggestion and don't know if it could help. You mention that your house keeps getting broken into. Could you set up some sort of camera? Even a "Nanny-Cam"? To try and get evidence of the break-in?

Just letting you know that I tried to download the audio recording (just so you'd have another backup), and the following happened: my browser crashed, and was unable to start back up. My anti virus software has literally disappeared from my computer (unable to find it listed in my programs, and the desktop icon is gone as well). I'm trying to redownload it. but it is giving me problems. Considering I updated my antivirus software this afternoon, and had run a scan less than an hour ago, the only possible conclusion is that it came from your download (I tried the mediafire one, ftr). IDK whats up with it, but yeah.

Good luck. <3

Here via law_questions.

Legalities regarding vaccinations aside, few modern vaccines contain thimerasol. There's really no reason to be worried about it, but if you are, just ask your doctor if the vaccines your kids are scheduled for contain thimerasol.

FYI, I downloaded the 2nd link to hear the message, gave my new laptop a virus called Antimalware doctor.

Yeah, your lawyer texting? Bad sign, right on the ball there.

Paper work: Demand copies of everything they have that you can get your hands on and copy them

Man, I live all the way over here in Australia and I want to let our news guys know about this shit, won't be much help, but it gets noticed on an internasional level? That'd have to do something, right? I wouldn't know where to go, but I could get my mum's help on that. I know she'd want to help stop something similar to what happened to us happen to anyone, most of all someone like you.

And everything missdewey said? Do that.

And remember, this isn't an impossible situation, it just feels like it, I know.
